These Terms of Use (the "Terms") govern your access to and use of the website frequenzwerk.com (the "Website"), operated by José Nolberto Olivo Ibáñez, sole proprietor, trading as Frequenzwerk Group, Dudenstraße 9, 10965 Berlin, Germany ("we", "us"). By accessing or using the Website you agree to these Terms. If you do not agree, please do not use the Website.
1. Scope of these Terms
These Terms apply solely to the corporate portal at frequenzwerk.com, which serves as an informational umbrella site presenting our independent projects and brands. They do not govern the use of, or any purchase made via, our subsidiary websites — including but not limited to powerindie.com, atrium-arts.com, iodistrict.com and auriamusic.de. Each of those services has its own Terms of Service / AGB and Privacy Policy, which apply once you visit or transact with them.
2. No Commercial Offering on this Portal
The Website itself does not sell goods or services, does not collect payment information, and does not enable user registration. It is provided as a static, informational presentation of the Frequenzwerk Group brand and its projects. All commercial transactions — including ticket sales, merchandise, bookings, and other paid services — take place exclusively on the respective project websites under their own contractual terms.
3. Intellectual Property
All content on this Website — including but not limited to the Frequenzwerk name, logo, custom typeface, the brand names and logos of Power Indie World, Atrium-Arts, IOdistrict, AURIA Music, all texts, images, graphics, video, audio, and the layout and design — are the property of José Nolberto Olivo Ibáñez / Frequenzwerk Group or used with permission, and are protected by German and international copyright, trademark and other intellectual property laws.
You may view and, for strictly private and non-commercial purposes, locally store excerpts of the Website. Any other use — including reproduction, adaptation, distribution, public display, rebroadcasting, or commercial exploitation — requires our prior written consent.
4. Permitted Use
You agree not to:
- use the Website in any way that violates applicable German or EU law;
- attempt to gain unauthorized access to the Website, its servers, or related systems;
- introduce malware, viruses, scrapers, or any technology intended to harm or interfere with the Website's normal operation;
- impersonate Frequenzwerk Group, any of its projects, or any person affiliated with them;
- use the Website's content or branding in a manner likely to cause confusion with, or misappropriate the reputation of, Frequenzwerk Group.
5. External Links & Third-Party Content
The Website contains links to our project websites and may contain links to other third-party websites. We have no control over the content, privacy practices or operation of any linked third-party site and accept no responsibility for them. Links are provided for convenience only and do not constitute endorsement.
6. Disclaimer of Warranties
The Website is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties or representations of any kind, express or implied, regarding the Website, its content, accuracy, completeness, fitness for a particular purpose, uninterrupted availability, or freedom from errors or harmful components. Information on the Website is for general informational purposes only and does not constitute legal, financial, or professional advice.
7. Limitation of Liability
We are liable in accordance with German statutory provisions for damages arising from (i) intent or gross negligence on our part, (ii) injury to life, body or health, and (iii) liability under mandatory law (such as the German Product Liability Act).
In all other cases — particularly for simple negligence — our liability is limited to a breach of material contractual obligations (so-called Kardinalpflichten) and to the foreseeable damage typical for this type of contract. Any further liability — in particular for indirect damages, loss of profit, loss of data, or third-party claims — is excluded to the extent permissible by law. The same limitations apply to our vicarious agents and employees.
8. Trademarks & Brand Identity
The word mark "Frequenzwerk" was filed for registration with the German Patent and Trade Mark Office (DPMA, Munich) on 19 May 2026 in Nice classes 35, 38 and 41; registration is pending DPMA examination. Until registration is granted, the mark is designated with "™"; the symbol "®" will only be used after the DPMA confirms registration.
"Frequenzwerk", "Frequenzwerk Group", "Power Indie World", "Atrium-Arts", "IOdistrict", "AURIA" and "AURIA Music", together with the associated logos, custom typeface, and design elements, are protected business identifiers and trademarks of José Nolberto Olivo Ibáñez (sole proprietor, Berlin) and have been in continuous use since 2020. They enjoy protection under §§ 4 No. 2, 5, 14, 15 MarkenG, § 12 BGB and §§ 3, 4, 5 UWG.
Any unauthorized use — including without limitation reproduction of logos or typefaces, use of the names in advertising, registration of identical or confusingly similar domain names, social-media handles, app names or company names, or any conduct creating the false impression of an affiliation with Frequenzwerk Group — will be pursued through cease-and-desist notices, injunctive relief, claims for damages, disclosure, and cancellation of conflicting registrations, at the infringer's cost (§ 14 (6) MarkenG, § 97 UrhG, § 9 UWG, § 12 (1) UWG). 9. Modifications to these Terms
We may update these Terms from time to time to reflect changes in our services or in applicable law. The current version is always available on this page. Continued use of the Website after changes take effect constitutes acceptance of the revised Terms.
10. Governing Law & Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with habitual residence in another EU Member State, you additionally enjoy the protection of any mandatory provisions of the law of that state.
The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms — to the extent legally permissible — is Berlin, Germany.
11. Severability
Should any provision of these Terms be or become invalid or unenforceable in whole or in part, the validity of the remaining provisions shall not be affected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes as close as possible to the economic intent of the original.
